General Contest Rules
The Red Bull Jersey Barriers Contest (the “Contest”) is being operated by Red Bull North America, Inc. together with its partner Musso Inc (referred to collectively herein as “Red Bull”).
To provide fair and equal chance of winning to all entrants of the Contest, the following are the official rules for the Contest.
NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.
All entrants must be 18 years of age or older, unless otherwise stated and/or posted.
The Contest begins on 5/06/2008 and ends on 9/30/2008 unless otherwise stated on the particular Contest entry page (the “Contest Entry Page”).
The Contest is open to all legal residents of the United States and the District of Columbia. Void where prohibited.
1. Entering Contest and Choosing and Contacting Winners
The winner of the Contest will be chosen based on the subjective judgment of the Contest judges (the “Judges”). All decisions of the Judges are final and binding.
To be a valid entry, an entry must:
- Be between 3 seconds and 40 seconds in length and no greater than 10 megs in size;
- Be in .mov or .flv format
- Contain content appropriate to the particular Contest as described on the Contest Entry Page;
- Be entered along with a valid email address and any other required information requested on the Contest Entry Page; and
- Not contain any illegal or obscene material.
Red Bull is not responsible for and will not consider incomplete, invalid or incorrect entries, as potential Contest winners.
The winner of the Contest will be contacted at the registered email address used to enter the contest, and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. Red Bull will mail the Contest prize to the address supplied by the recipient of the winner announcement email.
Claiming of the prize requires an email response to redbulljerseybarriers@gmail.com from the winning sender email address within thirty (30) days of being notified of winning at the email address used to enter. Failure to respond shall mean that the winner forfeits the prize. Red Bull is not required to award elsewhere any prizes forfeited by the chosen winner.
2. Rights
By submitting any video or information to Red Bull, you hereby grant to Red Bull and its affiliates, parents, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, perform, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted video or other information and to use all the names and likenesses included in the video in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Red Bull includes but is not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submitted video.
By submitting any video or information to Red Bull, you hereby represent and warrant that the video or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Red Bull herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances. You also hereby represent and warrant that you will not upload, post, email, transmit, or otherwise make available through Red Bull’s website any material that contains software viruses, worms, Trojan horses, bombs, or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or any telecommunications equipment.
You acknowledge and agree that although Red Bull does not pre-screen content posted as part of any Contest, Red Bull shall have no obligation to post, display or otherwise make publicly available any video or information submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any video or information that you submit to Red Bull.
You understand and intend that any video or information submitted by you to Red Bull may be available for viewing, rating, review and comment on by the public, and understand that Red Bull is not responsible for these comments or ratings, you will not interfere with, manipulate, or take any actions that may undermine the integrity of the comments or ratings in any way, and comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any video or information you submit to Red Bull. By submitting any video or information to Red Bull, you hereby waive any privacy expectations that you may have with respect to any such video or information submitted by you to Red Bull.
You hereby agree to hold Red Bull and its affiliates, parents, subsidiaries, directors, officers, members, licensees, sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any Red Bull site, or any other use authorized under these Terms, of any video or information submitted to Red Bull by you.
Physical copies of videos and/or information submitted by you to Red Bull shall be the property of Red Bull, and Red Bull shall have no obligation to preserve, return or otherwise make available to you or others any physical videos and/or information so submitted.
3. Awarding Prizes
The winners of the Contest shall receive one thousand dollars ($1,000.00) each for filmer, skater and skateshop, subject to all taxes, fees, and any other charges associated with the prize. The winners are solely responsible for all taxes and/or fees that may be incurred.
The winners are required to verify proper and legal picture identification and Social Security number within thirty (30) days of notification of winning the cash prize. The winners may forfeit any and all cash winnings if verification cannot or has not been made within thirty (30) days. Upon proper verification, cash winnings will be awarded by check, and mailed to winner’s mailing address within seven (7) business days.
The winners may not request substitutions of prize winnings.
Neither Red Bull, Red Bull sponsors, nor employees of Red Bull or sponsors may be held liable for any warranty, costs, damage, injury, or any other claims incurred as a result of any entrant’s actions in preparing submissions to the Contest. Red Bull is not liable for any loss arising out of or in connection with or resulting from any contest promoted by Red Bull.
4. General
Management, employees and families of Red Bull are prohibited from winning any prizes awarded by Red Bull.
Red Bull reserves the right to alter any rules of any Contest at anytime. If you have any questions or complaints about a Red Bull Contest, please contact redbulljerseybarriers@gmail.com.
Except where prohibited, participants agree that (1) any and all disputes, claims or causes of action arising out or connected with the Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration or alternate dispute resolution, as selected by Red Bull, to take place in Los Angeles County, State of California; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred in participation but in no event attorney’s fees; and (3) under no circumstances will a participant be entitled to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket costs, and any and all rights to have damages multiplied or otherwise increased.
Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these rules and the decisions of Red Bull in connection with the Contest, shall be governed by and construed in accordance with the laws of the State of California, without regard for conflict of laws doctrine.
Should any term or provision of these rules be concluded to be void, unenforceable or contrary to applicable law as provided herein, such term or provision shall, but only to the extent necessary to bring the rule within the requirements of such law, be deemed to be severed from the other terms and conditions; and the remainder of these rules shall be given effect as if it had not included the severed item.
For the name of the prize winners, mail a self-addressed stamped envelope to: Red Bull North America, Inc. “The Red Bull Jersey Barriers Contest” Winners List, 2525 Colorado Ave. Ste 320 Santa Monica, CA 90404 for receipt within one year of the conclusion of the Contest. The name of the winner may be posted on www.redbulljerseybarriers.com
